Terms of Service

These terms and conditions govern your access to and use of the Yandap platform and services.

Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Yandap platform ("Platform"), operated by Yandap ("Yandap," "we," "us," or "our").

By accessing or using the Platform, you ("Customer," "Property Owner," or "you") agree to be bound by these Terms. If you do not agree, you must not use the Platform.

Description of Services

Yandap provides a cloud-based software platform that enables Property Owners to:

  • Manage property portfolios
  • Maintain tenant records
  • Track leases, payments, and occupancy
  • Send communications to tenants, including automated messages via WhatsApp

Limitations of Service

Yandap is a technology provider only and does not:

  • Act as a landlord or broker
  • Participate in rental agreements
  • Mediate disputes between Property Owners and tenants

Account Registration and Responsibility

To use the Platform, you must:

Provide accurate and complete information

Maintain the confidentiality of login credentials

Be responsible for all activities under your account

You must notify us immediately of any unauthorized access.

Customer Responsibilities

Critical Clause

You are solely responsible for:

  • All data uploaded to the Platform
  • Ensuring the accuracy and legality of such data
  • Compliance with all applicable laws (including data protection and communication laws)
  • Obtaining valid tenant consent before sending communications

You explicitly agree that:

  • You will not rely on Yandap for legal compliance
  • You will independently ensure your use of the Platform is lawful

Acceptable Use Policy

You agree not to use the Platform to:

Send unsolicited, spam, or unauthorized messages
Harass, threaten, or abuse any individual
Violate privacy or data protection laws
Transmit illegal, harmful, or misleading content
Interfere with the security or functionality of the Platform

Yandap reserves the right to suspend or terminate accounts violating this section.

Messaging Services & WhatsApp Integration

6.1 Shared Infrastructure

Yandap provides access to a shared WhatsApp API infrastructure, which may be used by multiple customers.

6.2 No Guarantees

Yandap does not guarantee:

  • Message delivery
  • Delivery timing
  • Message visibility or response

6.3 Third-Party Dependency

Messaging services depend on third-party providers (e.g., WhatsApp). Yandap is not responsible for:

  • Service outages
  • API limitations or restrictions
  • Message blocking or account suspension

6.4 Consent Requirement

You must:

  • Obtain clear, informed consent from tenants
  • Maintain proof of such consent
  • Comply with all messaging regulations

Yandap assumes no liability for unauthorized communications.

Data Ownership and Roles

  • Ownership

    You retain ownership of all data you upload

  • Data Controller

    You act as the Data Controller for tenant data

  • Data Processor

    Yandap acts as a Data Processor, as outlined in the DPA

Fees and Payment

    All payments are non-refundable unless otherwise stated

    Failure to pay may result in suspension or termination of services

Intellectual Property

All rights, title, and interest in the Platform—including software, design, branding, and content—are owned by Yandap.

You are granted a limited, non-exclusive, non-transferable license to use the Platform. You may not:

  • Copy, modify, or reverse engineer the Platform
  • Resell or sublicense the Platform without authorization

Service Availability

Yandap strives to maintain reliable service but does not guarantee:

  • Continuous or uninterrupted operation
  • Error-free functionality
  • Compatibility with all devices or systems

We may modify or discontinue features at any time.

Suspension & Termination

We may suspend/terminate if:

  • You violate these Terms
  • You engage in unlawful or abusive conduct
  • Your use poses a risk to the Platform

Upon termination:

  • Access to the Platform will be revoked
  • Data may be deleted per Privacy Policy

Disclaimer of Warranties

"As Is" & "As Available"

The Platform is provided without warranties of any kind.

To the fullest extent permitted by law, Yandap disclaims all warranties, including:

Limitation of Liability

Critical Protection Clause

To the maximum extent permitted by law, Yandap shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profits, revenue, or business opportunities
Loss or corruption of data
Tenant disputes or property-related issues
Messaging failures or delays
Actions or omissions of third-party providers

Liability Cap

Total liability, if any, shall not exceed the amount paid by you to Yandap in the three (3) months preceding the claim.

Indemnification

You agree to indemnify and hold Yandap harmless from any claims, damages, or liabilities arising from:

Your use of the Platform
Violation of these Terms
Breach of applicable laws
Unauthorized or unlawful communications
Disputes with tenants or third parties

Data Protection

Your use is subject to:

You agree to comply with all applicable data protection laws.

Changes to Terms

We may update these Terms at any time. Updated versions will be posted with a revised "Last Updated" date. Continued use constitutes acceptance.

Governing Law

These Terms are governed by the laws of the:

Republic of Cameroon

Force Majeure

Yandap not liable for delays due to events beyond control:
